The Town of Champion Town Board met in regular monthly session on Monday, May 7, 2001 at 7:00PM at the Town Municipal Building. Present were Supervisor Buckley, Councilmen Watkins, Stewart, Buzzell, and Miller, Attorney Farley, and Highway Superintendent Martin.

Supervisor Buckley called the meeting to order at 7:00pm and opened the meeting for public comment. There were no comments from the public.

• Engineer-Mr. Dimmick reported on the status of districts with pending and current construction. The restoration of properties in Sewer District #1 is on schedule. All affected properties will be final graded and hydroseeded. The extension of Water District #3, to provide service to homes located on NYS Route 3 in the Town of Rutland, has been approved by RUD. Bonds and insurances for Water District #4 have been approved as to form by Attorney Farley. A pre-construction meeting for Water District #4 has been scheduled for May 10, 2001 at 12:00PM at the Village of Black River Municipal Building. The location was selected to accomodate the schedules of Rural Utility Services officers who have a prior pre-con at the site. Water District #4 construction is scheduled to begin on May 21, 2001.
• DANC-John Condino reported that work is continuing to refine the operation of the pump stations.
• Councilmen-Mr. Buzzell reported that Niagara Mohawk investigated the function of the outside light located at the back corner of the Municipal Building and determined that problem is not service related. Motion by Mr. Buzzell, seconded by Mr. Stewart to hire a private contractor to identify and repair the malfunction. Mr. Buzzell reported that the location of electric and gas services for the proposed Time Warner utilities building have been determined but that the site must be leveled prior to installation of services. Mr. Stewart reported that the Twin Village Pool Commission has met to prepare for the upcoming season. The recently formed Joint Recreation Commission will hold its organization meeting on Wednesday, May 15, 2001 at 4:00PM at the Village of West Carthage Municipal Building.
• Supervisor-Mr. Buckley reported that he had attended a conference held at Minnowbrook to discuss some of the aspects of rural development with several federal funding agencies.
• Highway Superintendent- Mr. Martin requested that the Board approve the purchase of a push lawn mower to replace an older mower that is beyond repair. Mr. Martin requested permission to offer the excessed grader for sale at municipal auction. Motion by Mr. Stewart, seconded by Mr. Buzzell to authorize sale of the grader at auction at a minimum price of $5000. Ayes-5, Nays-0. Motion carried. Mr. Martin reported that the area of the gravel pit, suited for top soil removal, is not included in the mining permit. He also reported on fence replacement on the Eddy Road and recommended constructing flanges on the culverts to properly divert the water. Mr. Martin recommended permanent improvements on the following roads based on bids from Suite-Kote: Lamb Road 7/10 mile $19,579; North Lake Road $8,590 to cover work began in 2000, additional $4,000 to complete to existing blacktop, and $2,000 for 60 feet of pipe; Jackson II Road 2/10 mile and Pine Drive $13,683. Mr. Martin informed the Board that the highway department will need 9,000 yards of sand for the 2001-02 winter season. Mr. Martin had a representative read a letter he received from the Town Attorney and his response to the letter (see attached).
• Assessor- Mr. White stated that Grievance Day will be 5/22/01.
• Town Attorney- Mr. Farley reported that he had prepared and delivered letters to two water district customers who were in violation of the water law. Both situations have been corrected.
• Zoning Officer - Report read and accepted.
• Parks- Mr. Eddy discussed the placement of the fence in the Village Green Park.

The Board reviewed the minutes for April 2 and April 9. Mr. Watkins requested that the section pertaining to the purchase of water from the Village of West Carthage reflect that charges will be assessed at $.10"KG". Motion by Mr. Miller, seconded by Mr. Stewart to approve the minutes as amended. Mr. Miller-aye, Mr. Stewart-aye, Mr. Buzzell-aye, Supervisor Buckley-aye, and Mr. Watkins-nay. Motion carried.

Motion by Mr. Watkins, seconded by Mr. Stewart to approve payment of the following bills:

The Supervisor's monthly report was read and reviewed by the Board. Motion by Mr. Miller, seconded by Mr. Buzzell to approve the report as presented. Ayes-5, Nays-0. Motion carried.

Supervisor Buckley presented correspondence received by his office including a request from Reginald Purington and John Young to extend Mosher Road and construct a turn around at the end. The Board reiterated its policy that private roads must be brought up to Town highway specifications to be considered for public designation by the Town Board.

Motion by Mr. Miller, seconded by Mr. Stewart to designate Cayuga Bank as a depository for Town funds. Ayes-5, Nays-0. Motion carried.

Motion by Mr. Stewart, seconded by Mr. Watkins to authorize the Supervisor to execute a loan/grant agreement, in the amounts of $100,000/$330,800 respectively, with USDA-Rural Utility Services for the purpose of constructing Town of Champion Water District #4. Ayes-5, Nays-0. Motion carried.

Motion by Mr. Buzzell, seconded by Mr. Stewart to authorize the following expenditures of highway monies for permanent road improvement:

Jackson II Road (7/10 mile) $13,683

Lamb Road $19,579

North Lake Road $8,590

Jackson II Road from NYS 26 past Richard Miller property will have asphalt removed, be re-graded, graveled and allowed to settle for a season. Ayes-5, Nays-0. Motion carried.

Motion by Mr. Stewart, seconded by Mr. Miller to authorize the purchase of a push lawn mower at a cost not to exceed $300. Ayes-5, Nays-0. Motion carried.

Motion by Mr. Stewart, seconded by Mr. Buzzell to go into executive session for the purpose of discussing personnel and litigation. Ayes-5, Nays-0. Motion carried. Executive session began at 9:55PM.

Motion by Mr. Miller, seconded by Mr. Buzzell to return to open session. Ayes-5, Nays-0. Motion carried. Open session resumed at 10:14PM.

Motion by Mr. Watkins, seconded by Mr. Stewart to adjourn. Meeting adjourned at 10:15PM.
