The Champion Town Board met in special session on Monday, June 19, 2000 at 7:00PM at the Champion Municipal Building. Present were Supervisor Buckley, Councilmen Stewart, Miller, Watkins, and Buzzell, and Attorney Farley.

Supervisor Buckley called the meeting to order and opened the meeting for comment from the public. Terry Freeman asked if a copy of the construction plans for Lamb Road were available for inspection. The Board responded that formal plans are not historically prepared and that the road will be constructed according to existing highway standards. Tim Freeman asked if plans were prepared for inspection in other Towns. Sam Eddy reported that road signs are being stolen and that a report has been filed with the Jefferson County Sheriff.

New Business

Supervisor Buckley presented a proposed inter-municipal agreement between the Towns of Champion and Rutland for the purpose constructing sewer facilities within the Town of Rutland. Motion by Mr. Stewart, seconded by Mr. Buzzell to authorize the Supervisor to execute the inter-municipal agreement with the Town of Rutland as presented. Ayes-5, Nays-0. Motion carried.

The Board reviewed language for a proposed amendment to Town of Champion Sub-Division Law concerning open development area. No action was taken pending Planning Board review.

The Board discussed standards for private roads in relation to proposed changes in the zoning and subdivision laws that would allow for subdivision and construction on lots that do not abut public highways. Referring to Section 8-subbase standards, the Board endorsed using the categories and descriptions as written with the deletion of references to pavement. The Board further considered additional language to address issues of crowning, road width, shoulder width, ditching, and approval of the constructed road contingent on the inspection and report of the Highway Superintendent.

Attorney Farley recommended the addition of language to require an executed road maintenance agreement at the time a lot is purchased to indemnify the Town against suits alleging road defects. It would be necessary to add this item to the zoning permit checklist to insure compliance.

It was the majority opinion of the Board that the amended sections of the land use laws reflect the changes in the status of private roads only as they relate to open development areas. No action was taken pending a review of the proposals by the Planning Board.

Motion by Mr. Watkins, seconded by Mr. Stewart to recommend Brian Phelps for appointment to the Jefferson County Planning Board. Ayes-5, Nays-0. Motion carried.

Motion by Mr. Miller, seconded by Mr. Buzzell to authorize the Supervisor to execute a contract with the Carthage Area Chamber of Commerce to appropriate $250.00 for the July 8, 2000 fireworks display. Ayes-5, Nays-0. Motion carried.

Motion by Mr. Miller, seconded by Mr. Stewart to appoint James Yuhas to a four-year term on the Branaugh Memorial Club, Inc. Board of Trustees. Ayes-5, Nays-0. Motion carried.

Supervisor Buckley reported that the proposed boundaries for Champion Water District #4 have been reviewed with the Town engineers. The proposed boundaries would include the Cole Road in its entirety, from the Cole Road intersection with the Sayre Road south to NYS Route 126, and from the Cole Road intersection with the Sayre Road north to include the highest concentration of residences. Water for the District would be purchased from the Twin Villages system. Motion by Mr. Stewart, seconded by Mr. Miller to authorize the Supervisor to execute a contract with the Town engineer to perform a feasibility study for the construction of Champion Water District #4 in an amount not to exceed $3,200. Ayes-5, Nays-0. Motion carried.

Mr. Miller reported that William Marielly, NYS Route 126 continues to have a problem with flooding of his cellar. DANC operations and maintenance personnel will be instructed to investigate the problem.

Motion by Mr. Stewart, seconded by Mr. Buzzell to go into executive session for the purpose of discussing personnel. Ayes-5, Nays-0. Motion carried. Executive session began at 8:30PM.

Motion by Mr. Miller, seconded by Mr. Stewart to return to open session. Ayes-5, Nays-0. Motion carried. Open session resumed at 9:15.

Motion by Mr. Watkins, seconded by Mr. Stewart to appoint Brian Sech to a probationary appointment to the highway department at an hourly rate of $10.50 per hour pending the results of a physical and substance testing. The probationary period will begin on the initial day of employment for a term of sixty days. Ayes-5, Nays-0. Motion carried.

Motion by Mr. Miller, seconded by Mr. Watkins to appoint Wanetta Monahan to a probationary appointment as meter reader and to duties as assigned on an as needed basis including but not limited to lawn mowing at a hourly rate of $10.00 per hour pending a physical and substance testing. The probationary term will begin on the initial day of employment for a term of sixty days. Ayes-5, Nays-0. Motion carried.

Motion by Mr. Miller, seconded by Mr. Stewart to adjourn. The meeting adjourned at 9:30PM.
