The Champion Town Board met in special session on Monday, October 26, 1998 at 7:00PM. Present were Supervisor Buckley, Councilmen Miller and Stewart, Attorney Farley and ten members of the public. Councilmen Watkins and Buzzell were absent.

Supervisor Buckley called the meeting to order at 7:00PM.

Proof of Notice having been furnished, the Public Hearing on the formation of Champion Water District #3-Hamlet of Great Bend extension was called to order at 7:00PM by Supervisor Buckley.

No one spoke in favor of the formation of the district.

The following person spoke against the formation of the district:

Leonard Gillen

All persons desiring to be heard, having been heard, the Hearing was terminated at 7:15PM.

Proof of Notice having been furnished, the Public Hearing on the establishment of Champion Fire District #1-Great Bend Service Area was called to order at 7:15PM.

The following person spoke in favor of the establishment of the district:

John Illingworth

No one spoke against the establishment of the district.

All person desiring to be heard, having been heard, the Hearing was terminated at 7:28PM

Proof of Notice having been furnished, the Public Hearing on the alteration of the boundaries of fire protection district #1 by exclusion of territory was called to order at 7:28PM.

No one spoke for or against the alteration of the boundaries.

All persons desiring to be heard, having been heard, the Hearing was terminated at 7:29PM.

Proof of Notice having been furnished, the Public Hearing on amending Local Law #4 for 1997-Town Zoning Law was called to order at 7:30PM.

No one spoke for or against amending the zoning law.

All persons desiring to be heard, having been heard, the Hearing was terminated at 7:33PM.

The Board reviewed and responded to the SEQR regarding Champion Fire District #1. Motion by Mr. Stewart, seconded by Mr. Miller to make a declaration of negative impact to the environment. Ayes-3, Nays-0. Motion carried.

The following resolution was offered by Mr. Miller, seconded by Mr. Stewart: WHEREAS, the establishment of Champion Fire District #1 is in the best interest of the public,

BE IT RESOLVED, that Champion Fire District #1-Great Bend Service Area be established.

Ayes-3, Nays-0. Resolution adopted.

The following resolution was offered by Mr. Miller, seconded by Mr. Stewart:

WHEREAS, it is in the best interest of the public to modify the boundaries of the Town of Champion Fire Protection District #1 by the exclusion of territory,

BE IT RESOLVED, that the boundaries of the Town of Champion Fire Protection District #1 be altered by the exclusion of territory.

Ayes-3, Nays-0. Resolution adopted.

The Board reviewed and responded to the SEQR in regards to Champion Water District #3-Hamlet of Great Bend extension. Motion by Mr. Stewart, seconded by Mr. Miller to make a declaration of a negative impact on the environment as a result of the proposed action. Ayes-3, Nays-0. Motion carried.

The following resolution was offered by Mr. Miller, seconded by Mr. Stewart:

WHEREAS, the notice to the public was sufficient; that all property within the district is benefited; that all property that could benefit has been included; and that the formation of the district is in the public interest,

BE IT RESOLVED, that the Town Board approve the formation of Champion Water District #3-Hamlet of Great Bend extension.

Ayes-3, Nays-0. Resolution adopted.

The Board reviewed and responded to the SEQR in regards to Local Law #5 for 1998-Amendment to Local Law #4 for 1997. Motion by Mr. Stewart, seconded by Mr. Miller to make a declaration of a negative impact on the environment as a result of the proposed action. Ayes-3, Nays-0. Motion carried.

Motion by Mr. Stewart, seconded by Mr. Miller to adopt Local Law #5 for 1998-Amendment to Local Law #4 for 1997. Roll call vote: Mr. Stewart-aye, Mr. Miller-aye, and Supervisor Buckley-aye. Motion carried.

Motion by Mr. Stewart, seconded by Mr. Miller to adjourn. Meeting adjourned at 7:52PM.
