The Champion Town Board met in special session Monday, June 15, 1998 at 8:30AM at the Municipal Building to discuss the water law for Champion Water District #2 and other necessary business. Present were Supervisor Buckley, Councilmen Stewart and Miller, Highway Superintendent Martin, and water committee members: L. Barker, B. Ferguson, and C. Wangerin. A letter was received from committee member S. Emerson stating his view (see attached).
The Board and committee discussed the structure of the water fees. The consensus was to implement the following:
INSIDE DISTRICT
Flat rate charge: 0-12,500 gallons $77/quarter
Over 12,500 gallons .$4/KG
OUTSIDE DISTRICT
All water: $4.00/KG
The Board and committee agreed that no individual or group should make connections to hydrants except in the case of fire or fire fighter training. All tankers supplying water to individuals either inside or outside the water district shall be filled from a metered hookup.
The committee suggested that the Board enact legislation concerning the delivery of water by tanker stating "that the Town of Champion shall not be responsible for the quality of water after it leaves the pipe". Attorney Farley will be asked for his recommendation.
Motion by Mr. Stewart, seconded by Mr. Miller to schedule a public hearing on Local Law #5 for 1998-Champion Water District #2 Water Law for Monday, July 6, 1998 at 7:00PM. Ayes-3, Nays-0. Motion carried.
Jake Fuller, Fuller Insurance Agency Inc., was present to discuss the Towns insurance coverage, specifically replacement value. Mr. Fuller stated that insured equipment ten (10) years or newer is replaced at full value. All equipment over ten (10) years old is replaced at actual cash value. Language may be included in the insurance contract to replace items on an agreed figure.
The Board authorized Highway Superintendent Martin to determine the value of particular pieces of equipment and submit the information to Mr. Fuller for consideration and negotiations with the underwriter.
Mr. Fuller presented the costs for increasing the mutual aid coverage. The Board considered the following coverage and costs:
$100,000 current coverage
$200,000 ..$80 additional premium
$500,000 ..$110 additional premium
$1,000,000 ..$219 additional premium
Motion by Mr. Stewart, seconded by Mr. Miller to increase the coverage for mutual aid to $500,00 at a cost not to exceed $110.00. Ayes-3, Nays-0. Motion carried.
Supervisor Buckley reported on the status of the West Carthage Industrial Park. The Village has agreed to install water and sewer service and is seeking assistance from the Town of Champion to construct a roadway into the park from NYS Route 26. The Village is requesting 3500 yards of fill and gravel screened at Village expense, trucking of the gravel, and use of the dozer. Highway Superintendent Martin agreed to provide the requested services but expressed concerns about the availability of men and equipment this summer.
Highway Superintendent Martin recommended to the Board the purchase of a chipper, trailer and hydraulic hose machine. No action was taken.
The Board discussed the problems with posting the Whitaker and Lamb Roads to "no thru trucks". It was the consensus of the Board that this would be an unreasonable burden to self employed truckers. Motion by Mr. Miller, seconded by Mr. Stewart to designate the Whitaker Road for heavy trucks.
Ayes-3, Nays-0. Motion carried.
The Board reviewed the recommendation from Bernier, Carr & Associates for renovations and repair to the Town Highway Garage roof and ventilation system. The engineers recommend the refastening and recoating of the existing roofing system and the installation of two (2) power roof exhausters, ducts, and ceiling fans. Motion by Mr. Stewart, seconded by Mr. Miller to solicit separate bids for the repairs to the roof and for the ventilation system for opening at the July Board meeting. Ayes-3, Nays-0. Motion carried.
William Marielly, NYS 126, was present to apprise the Board of problems that he has had with his water system and washing machine due to the presence of considerable amounts of sediment in his water. Mr. Mariellys service line has been broken during the construction of the Champion Water District #2 and the sediment introduced during repairs. Mr. Marielly is asking the Town to assume the financial responsibility for repairs to his water system. Supervisor Buckley agreed to consult with the Town insurance company.
Motion by Mr. Miller, seconded by Mr. Stewart to adjourn. The meeting adjourned at 11:10AM.
